Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("Learner", "Customer", "you") and Learners Ink ("Learners Ink", "we", "us", "our") and govern your access to www.learnersink.com, every Learners Ink subdomain, and any classroom, live-online, e-learning, corporate or hybrid training service we deliver. By using the website, enquiring, enrolling, or accepting training, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a contract in your jurisdiction. By enrolling, you confirm that you meet the prerequisites of the chosen certification body (for example PMP requires 36 months of project management experience and 35 contact hours of formal education) and that the information you have given us is true.
2. Enrolment and payment
An enrolment is confirmed only when full payment, or the agreed first instalment for our 0% EMI plans, is received and we have issued an enrolment confirmation email with your cohort ID. Prices are listed in USD on the global site and may be charged in your local currency by your card issuer or wallet at their conversion rate. Applicable taxes (GST in India, VAT where relevant) will be added at checkout and shown before payment. All fees are exclusive of any income tax withholding required by your local tax authority on B2B invoices, which is your responsibility.
3. What is included
Unless your specific course page says otherwise, your fee includes accredited courseware, instructor-led sessions for the duration listed, session recordings for 12 months, official exam voucher where the course page lists "voucher included", official Learners Ink certificate of completion, simulator and mock-test access, and access to our learner support channel for the duration of your cohort plus 90 days. The following are never included unless explicitly stated: travel, accommodation, visa, exam re-attempts, late-fee penalties at the exam body, third-party books, and any continuing certification renewal fee due to the accreditation body in later years.
4. Code of conduct
You agree to attend sessions punctually, keep your camera on for live cohorts where requested, refrain from recording or redistributing our copyrighted material, respect peers and instructors, and follow the academic integrity rules of the relevant exam body. We reserve the right to remove a learner from a cohort without refund for sustained disruption, harassment, plagiarism, exam impersonation, or sharing of confidential exam content. Such removal does not waive any other legal remedy available to us.
5. Intellectual property
All courseware, slides, simulators, video recordings, templates, branding and copy on Learners Ink platforms are the property of Learners Ink or its licensors (including PMI, AXELOS, PeopleCert, Scrum Alliance, IIBA, IASSC, ISC2, EC-Council, AWS, Microsoft) and are protected by copyright, trademark and other intellectual property laws. Your enrolment grants you a personal, non-transferable, non-sublicensable, revocable licence to access and use the materials solely for your own learning during the entitlement window. You may not reproduce, share, sell, post on file-sharing or AI training platforms, or use the materials to train any third party, automated system or large language model. Violation will result in immediate termination, a claim for liquidated damages of USD 10,000 per violation, and full cost recovery.
6. Trademarks
PMI, PMP, CAPM, PMI-ACP and the PMI Authorized Training Partner mark are registered trademarks of Project Management Institute, Inc. ITIL is a registered trademark of AXELOS Limited, used under licence. PRINCE2, MSP and MoP are registered trademarks of AXELOS Limited. CSM and CSPO are registered marks of Scrum Alliance. AWS is a trademark of Amazon Web Services, Inc. Microsoft and Azure are trademarks of Microsoft Corporation. All other marks are property of their respective owners. Use of these names by Learners Ink is solely to identify accreditation and training scope.
7. Rescheduling, cancellation and refunds
Rescheduling, cancellation, refunds, and the money-back guarantee are governed by our Rescheduling Policy, Refund Policy, and Money-Back Guarantee pages, which form an integral part of these Terms. In the event of conflict, those specialised policies prevail over this section.
8. Exam vouchers
Where your fee includes an exam voucher, the voucher is issued by the accreditation body and is subject to that body's own terms, including validity windows (typically 6 to 12 months), naming, identity verification, and re-take rules. Once we have requested or transmitted the voucher to you, it is treated as consumed for refund purposes. Lost or unused vouchers cannot be reissued by Learners Ink unless the accreditation body explicitly permits it.
9. Pass guarantee and re-attendance
For courses that advertise "100% pass guarantee" we offer one free live-online re-attendance of the full cohort if you fail the official exam after attending at least 95% of sessions, completing all assignments, and scoring at least 80% in two of our official simulator mock tests. Re-attendance must be claimed within 90 days of your fail result and is not exchangeable for refund, cash, or credit toward another course. Detailed terms are on the Money-Back Guarantee page.
10. Corporate training and group bookings
For corporate or group bookings of 5 or more learners under a single purchase order, terms are governed by the signed Master Services Agreement or Statement of Work between Learners Ink and the customer entity. To the extent not addressed there, these Terms apply. All corporate offers, custom curricula, dedicated instructor allocations and on-site delivery require a written quotation and signed SOW.
11. Promotions and discount codes
Discount codes such as LEARN10 can only be used once per learner per course, cannot be combined with any other offer, are not redeemable for cash, and may be withdrawn or modified at our sole discretion with prior notice. We reserve the right to refuse a discount where the code has been used fraudulently or in bulk by automated systems.
12. Third-party links
Our site contains links to third-party platforms, including accreditation bodies, payment processors and external blogs. Their availability, content, and terms are outside our control and we disclaim responsibility for them.
13. Warranties and disclaimers
To the maximum extent permitted by law, the website and training services are provided on an "as is" and "as available" basis. We disclaim all implied warranties of merchantability, fitness for a particular purpose, non-infringement and quiet enjoyment. We do not warrant that the website will be uninterrupted or error-free, or that any learner will pass any exam, secure any salary increase, or receive any specific job offer. Outcomes depend on the learner's own effort.
14. Limitation of liability
To the maximum extent permitted by law, Learners Ink's aggregate liability for any claim arising out of or relating to these Terms, the website or the training shall not exceed the fees actually paid by you for the specific cohort that gives rise to the claim, in the 12 months preceding the event. In no case shall we be liable for indirect, special, incidental, consequential, exemplary, punitive damages, loss of profit, loss of opportunity, loss of data, or reputational loss, whether arising in contract, tort, statute or otherwise, even if advised of the possibility.
15. Indemnity
You agree to indemnify and hold Learners Ink, its officers, directors, employees, instructors and partners harmless from any third-party claim, loss, damage or expense (including reasonable legal fees) arising from your breach of these Terms, infringement of any intellectual property right, or violation of any applicable law.
16. Force majeure
Neither party shall be liable for failure or delay in performance caused by acts of God, war, terrorism, pandemic, government action, internet outages outside its control, cyber-attacks, strikes, or other events beyond reasonable control. In such cases, classroom cohorts may be temporarily moved to live-online delivery without constituting a breach.
17. Governing law and dispute resolution
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute shall first be attempted to be resolved by good-faith negotiation. Failing that, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act 1996 of India, by a sole arbitrator appointed mutually, seat and venue at Bengaluru, language English. The courts at Bengaluru, Karnataka shall have exclusive jurisdiction to support, enforce or set aside the arbitral award. Mandatory consumer-protection rules of your country of residence are preserved.
18. Severability and entire agreement
If any provision is held unenforceable, the remainder shall continue in full force. These Terms together with the Privacy Policy, Rescheduling Policy, Refund Policy and Money-Back Guarantee constitute the entire agreement between you and Learners Ink and supersede all prior communications.
19. Changes
We may update these Terms from time to time. The revised version takes effect when posted, except material changes affecting your existing cohort, which require 14 days' notice. Continued use of the website after the effective date constitutes acceptance.
